In these terms "we" and "us" mean the seller. VisionSwarm is a multi-agent simulation platform that uses artificial intelligence to generate predictive scenarios: you create simulations with virtual agents, watch them interact and generate reports.

The Service is reserved for professionals and businesses acting for purposes related to their trade, business or profession. It is not intended for consumers. By accepting these terms you declare that you use the Service for your professional or business activity.

You need an account to use the Service. You are responsible for keeping your credentials secure. An account is personal and may not be shared.

• The Service offers a free plan and paid plans. Prices are listed on the website and exclude VAT, which is added where applicable.
• The Pro plan starts with a 7-day free trial. Unless you cancel before the trial ends, the first charge is made at the end of the trial; the date and amount are shown before you confirm the payment.
• Paid subscriptions renew automatically every month until you cancel. You can cancel at any time from the billing portal; access remains active until the end of the period already paid.
• Periods that have already started are not refunded, except where the law requires it.
• Unused monthly credits do not roll over and expire at the end of each billing period.
• We may change prices with 30 days' notice by email; the new price applies from the following billing period.
• Payments are processed by Stripe.

You agree not to use the Service to:

• generate illegal, defamatory or hateful content
• attribute statements to real people, or spread content generated by the Service as if it were authentic statements of real people
• profile individuals
• influence elections or referendums
• upload personal data you have no right to use
• manipulate financial markets
• intentionally overload the system with excessive simulations
• attempt to access other users' data
• use the Service through unauthorised bots or automated scripts
• resell access to the Service without our written authorisation

You guarantee that you hold the rights needed to upload and use the material you provide, including, when it contains personal data, a valid legal basis under data protection law. You remain the owner of your material and of the reports and results generated from it, and you may use them freely.

The software, its design and the VisionSwarm brand belong to Salvatore Amideo. These terms give you a non-exclusive, non-transferable right to use the Service for the duration of the contract.

Reports, agents' statements and every other output are text generated by artificial intelligence. Scenarios are probabilistic estimates, not forecasts: they may be inaccurate or incomplete and we give no guarantee about them. The output does not constitute financial, legal, medical or any other professional advice. Decisions you make on the basis of the output are your responsibility.

We strive to keep the Service available but do not guarantee uninterrupted operation. Interruptions may occur for maintenance, updates or causes beyond our control. In the event of prolonged outages we extend the subscription period of paying customers.

We may suspend your account immediately in case of a serious breach of these terms, non-payment, or a risk to the security of the Service or of other customers. For other breaches we may terminate the contract with 7 days' notice by email.

You may close your account at any time from the Settings page. Closing it deletes your simulations and the related data immediately and permanently; an active subscription is cancelled and not refunded for the period already started.

The Service is provided as it is. Our total liability towards you for any claim arising from the contract is limited to the fees you paid in the 12 months before the event that caused the damage. We are not liable for indirect damages, loss of profit or business interruption.

These limits do not apply in case of wilful misconduct or gross negligence, nor to any liability that cannot be limited by law.

How we process personal data is described in the Privacy Policy. For the material you upload and the output of your simulations we act as your processor under the Data Processing Agreement, which is part of these terms and is accepted with them.

We may change these terms. We notify substantial changes by email at least 30 days before they take effect. Until then you may withdraw from the contract without penalty by closing your account. When the changes take effect you will be asked to accept the new version before you continue using the Service.

These terms are governed by Italian law.

Any dispute arising from these terms falls under the exclusive jurisdiction of the court of Milan, Italy.

Specific approval. Under articles 1341 and 1342 of the Italian Civil Code you approve specifically, with a separate confirmation when you accept these terms, clauses 10 (Suspension and termination), 11 (Limitation of liability), 13 (Changes to these terms), 14 (Governing law and jurisdiction).
